Welcome to the “Point of Zion” website operated by the “Nekudat Zion” association – to strengthen and preserve the heritage of IDF soldiers throughout the generations (580728046 “The Site” and “The Association“, respectively).

The use of the Site, including the content contained therein and the services it offers, indicates your agreement to these terms as well as to additional terms appearing on the Site, including the Privacy Policy as well as additional provisions and rules that may be presented to you during the use of the Site and these Terms of Use (collectively: the “Binding Documents“).

The mandatory documents are drafted in the masculine form for convenience only, but they apply to all genders.

You are requested to read the binding documents carefully, as they define your rights and obligations in relation to the use of the Website. The binding documents apply to the use of the Site through any computer or other communication device (such as smartphones, smart watches, tablets, etc.).

In binding documents, the term “content” or “content” means any literal, visual, audio or any combination thereof (such as audiovisual videos) or any part thereof as well as designs, their processing, editing and the way they are presented.

If you do not agree to the Terms of Use, or any part thereof, you are requested not to make any use of the Site.

About the site in a nutshell

On the site you can view testimonies and memories of IDF soldiers who no longer serve in compulsory or permanent service (“IDF soldiers“), as well as upload original content and share memories of your military service. The site is a digital social platform that enables IDF soldiers throughout the generations to share their personal stories and weave together a full network of authentic and reliable testimonies. The organization has the sole discretion to decide what content will be displayed on the site, the length of time it will be displayed, its location and design, and any other matter related to them.

The association may allow through the site a referral or links to social networks and various online services. The use of such social networks, or any other online service, is at your own risk and by its nature is subject to the legal agreements (such as the Terms of Use and Privacy Policy) governing the activity of these services (which are not on behalf of the Association).

Use of the Site

Viewing of the site is not blocked by age, but the association designates the content to those over the age of 15.

If you are under the age of 18, you may create a profile on the site and upload content to the site only if the organization has received a signed consent form from your parents. The Site, its contents and services may not be used in a manner other than that specified in the rules below, unless you have received the express consent of the Association to do so, in advance in writing, and subject to the terms of that consent. The use of the Website is for private purposes only and for non-commercial purposes, unless explicitly stated otherwise;

You may not copy and use, or allow others to copy and use, in any other way the content from the Site, including on other websites and applications, electronic publications, print publications, etc., for any other purpose;

It is forbidden to activate or enable the operation of any computer application or any other means, including programs such as Robots, Crawlers, etc., for the purpose of searching, scanning, copying or automatically retrieving content from the Site. In this regard, it is forbidden to create or use such means for the purpose of creating a compilation, collection or database that will contain content or information from the Site;

You may not link to the Site and the content on the Site from any source that contains pornographic content, content that encourages racism or wrongful discrimination, or content that is against the law, or that encourages illegal activity, or whose publication is against the law; The Association will not bear any responsibility for any damage caused as a result of any link to content originating on the Site and from any presentation or publication of content in any other way. You bear full and exclusive responsibility for any linking, presentation or publication of the content, made by you and undertake to indemnify the association for any damage caused as a result.

Providing details and uploading content

Opening a profile on the site involves registering and providing personal information and identifiers, such as full name, active email address and other details as needed. As explained above, opening a profile on the site for those under the age of 18 is also possible to obtain a consent form signed by the parents.

You may be required to actively and explicitly confirm your consent to the terms of the binding documents or part thereof. You may complete the registration in any of these cases after providing the requested details during the course of the process and after obtaining your consent to all the binding documents, or to any of them. You must provide only correct, accurate and complete details. Providing incorrect information may prevent you from using the full features of the Site and its services. It is clarified that your use of the Site, your participation in it, the delivery of content by you to the Site (insofar as you provide), and any use by the Company of the content you have provided, will not entitle you to monetary consideration or any other benefit.

The association encourages freedom of expression and the existence of relevant content on the site, with the active participation of you and the other users of the site. At the same time, in order to enable the existence of a cultural and substantive discourse and to prevent the abuse of the open possibilities to express oneself on the site, or to use its services, the association may check the content before and after its publication on the site. Such checks will be carried out solely to try to prevent the publication of content that is illegal on its face, or otherwise inappropriate. Accordingly, the site administration may at any time make an independent decision regarding the removal of offensive or illegal materials.

By uploading content to the site, you grant the organization unlimited permission in time and place, to use the content you have uploaded, including but not limited to advertising the site on various platforms. If you would like the content you have uploaded to the Site to be removed from it or related posts, please contact us at the info@nekudat-zion.org email address, stating your full name, the content you would like to be removed, and the date the content was uploaded – as far as is known.

Content that is prohibited for publication on the site

You are responsible for the content you submit to the Site. You must ensure that this content is legal and appropriate. Among other things and for the sake of example only, you must refrain from submitting for publication on the site, or through the site –

• content that you know is false, misleading or distorted;
•  Content that infringes or violates the proprietary rights of others – including copyrights and trademarks;
• pornographic or sexually explicit content;
• content relating to or identifying minors, their personal details or address and ways of communicating with them;
• Any computer program, computer code or application that contains a computer virus, including hostile programs known as Trojan horses, worms, vandals, malicious applications, etc.;
• passwords, usernames and other details, which enable the use of computer programs, digital files, websites or services, which require registration or payment, without payment or registration as aforesaid;
• Content that constitutes defamation of a person, or that violates his privacy, or good name;
• content that personally identifies other people, without their consent to the publication of their identity;
• content of a harassing, insulting, hostile, threatening or rude nature;
• Content that is racist, or discriminated against on the basis of race, origin, skin color, ethnicity, nationality, religion, sex, occupation, sexual orientation, illness, physical or mental disability, belief, political view, or socioeconomic status, or that encourages any of the above;
• content that encourages the commission of a criminal offense or that may form the basis for a civil claim or liability;
• content of an advertising or commercial nature;
• content to which access is blocked by a password, etc. and is not freely possible for all Internet users;

Reporting inappropriate or infringing content

The association encourages and maintains a fruitful and cultural discourse on the site, using proper language and respecting the rights of the participants in the community and any other person. The association respects the intellectual property rights of others, and asks users of the site to do the same.

Your request must include the following information:

• Your full name;
• an active e-mail address of yours, so that we can contact you;
• a brief description of the inappropriate content posted on the site;
•  A link to a page on the site posted on which the content you claim is inappropriate.

If your inquiry relates to copyright infringement, your request must include the following information:

• Identification of the protected work in which you claim that the copyright has been infringed. If your inquiry includes a report of several works, please attach sufficient details regarding each and every work;
• Identification and location of the content on the Site that you claim infringes the copyright in the protected works you have reported, and whose removal and/or denial of access to it is requested by you (the “Allegedly Infringer Content“);
• Your contact details: full name, telephone number and active e-mail address;
• A statement that you have a good faith belief that the use of the Site in the allegedly infringing content constitutes prohibited and unauthorized use by the copyright owner and/or its representatives and/or the provisions of the law;
•  A statement that all information provided by you is true and accurate;

After receiving your inquiry, the association may contact you to provide it with additional information for the purpose of investigating your complaint.

Please note: Any user of the site may report inappropriate content to the association, even if he is not a registered user. The Association will examine the content that is the subject of your complaint and will consider removing it or blocking access to it only if it believes that the content violates the Terms of Use of the Site, and the culture of proper discourse, and in particular if it is evident on its face that the content is prohibited from being published on the Site, in accordance with the section “Content prohibited for publication on the Site” that appears above.

The association does not undertake to remove any content that is claimed to be inappropriate. The Association may change the said arrangement at any time at its sole discretion, or in accordance with the requirements of the law. Any action that the association chooses to take following the receipt of a complaint does not constitute an admission that the content is appropriate or inappropriate.

Similarly, any user of the site, who believes that his copyright or the copyright he represents has been infringed, may report infringing content to the organization, even if he is not a registered user. The association will review the allegedly infringing content and will consider removing it or blocking access to it only if it believes it is indeed infringing a third party’s copyright. It should be emphasized that the association does not undertake to remove any content that is claimed to be infringing on copyright. The association may change the said arrangement at any time at its sole discretion, or in accordance with the requirements of the law. Any action that the association will take following the receipt of a complaint does not constitute an admission of the existence or non-existence of copyright infringement.

Links

When using the Site, you may find links to various pages and content on the web. Most of the content to which the links will be addressed is not published by the association, or on its behalf, and the association does not control or supervise them. The fact that the site links to such content does not indicate the association’s consent to their content and does not constitute a guarantee of their reliability, up-to-dateness, legality, the practices of the content owners in the field of privacy and any other aspect involved in their operation. You may find that this content does not suit your needs,  or you object to their content, or believe that they are outrageous, irritating, inappropriate, illegal or immoral. The association is not responsible for the content to which the links lead and is not responsible for any consequence caused by their use or reliance on them. The Association does not guarantee that the links found on the Site will be intact and will lead you to an active web page and it may remove from the Site links that were previously included therein, or refrain from adding new links – all at its absolute discretion.

The Association respects your privacy when using the Website. The website’s privacy policy is an integral part of the binding documents. Because the Privacy Policy may change from time to time, it is recommended that you review it from time to time.

Intellectual

All copyrights and intellectual property rights in the Site, in the services provided therein and in the content contained therein belong solely to the Association, or to other third parties (including users of the Site who upload content to it), who have permitted the Organization to use them. You may not copy, distribute, publicly perform, transmit, make available to the public, modify, process, create derivative works from, sell or rent any part of the above, whether by you or through or in collaboration with a third party, in any way or by any means, whether electronic, computerized, mechanical, optical, photographic or recording means, or by any other means and way, without obtaining the prior written consent of the Association or the other rights holders,  As the case may be and subject to the terms of the consent (insofar as it is given).

These Terms of Use do not prevent the use of the content on the Site in accordance with the provisions of the Copyright Law, 5768-2007, such as fair use. In any case, it is mandatory to provide the name of the creator(s) when using the item. It is forbidden to offend the dignity or reputation of the creator by distorting or altering the work.

Trademarks and advertisements of advertisers on the Site (if any), including supporters and sponsors, are the property of those advertisers only. The word “responsibility” also refers to the responsibility of the association’s employees, managers and those acting on its behalf or on its behalf. The Association does not guarantee that the services and content of the Site will not be interrupted, will be provided regularly or without interruptions, will take place safely and without errors, and will be immune from unauthorized access to the Association’s computers and databases, or against damages, malfunctions, malfunctions or failures – all in hardware, software, communication lines and systems, at the Association or at any of its suppliers.

Indemnification
You undertake to indemnify the Association, its employees, managers or anyone acting on its behalf for any damage, loss, loss of profit, payment or expense incurred by it – including attorney’s fees and legal expenses – due to violation of these Terms of Use or any of the binding documents.

Changes and discontinuation of activity

The Association may change from time to time the structure of the Site, its appearance and design, the scope and availability of the services therein and will be entitled to change any other aspect of the Site – all without the need to notify you in advance. Such changes will be made, inter alia, taking into account the dynamic nature of the Internet and the technological and other changes occurring therein. By their nature, such changes may involve malfunctions or initially cause inconvenience, etc. Without derogating from the aforesaid, the Association shall be entitled to terminate at any time the provision of services and content on the Site, in whole or in part. Change in binding documents, the Association may change the Terms of Use or any of the binding documents from time to time. Your continued use of the Site after the change in the Terms attests to your agreement to the new Terms and/or to the relevant binding document. If you do not agree with the updated version of the relevant binding document, you must cease further use of the Site. In any case, you can always view the most current version of the Terms of Use and other binding documents using the dedicated buttons on the site. The law and jurisdiction over the use of the Website shall apply solely to the laws of the State of Israel. Jurisdiction over all intents and purposes arising from the binding documents or the Website is vested exclusively in the competent courts in the Tel Aviv District, Israel.

Check

You may not transfer or assign rights under the binding agreements without obtaining the prior written consent of the Association. The Association may transfer its rights in the Site or any part thereof to any third party, at its absolute discretion, provided that such third party accepts the Association’s obligations to you according to the binding documents.
